Rental Registration Affidavit of Occupancy – Family Member

On July 10, 2018, the Beaver Borough Council approved a Rental Registration and Inspection Program in the Borough effective January 1, 2019.  The rental registration and inspection program applies to all non-owner occupied dwelling units that are rented to non-family occupants.

If a family member (parent, parent-in-law or adult child of the owner) are living in the home and no net income is earned by the owner, a signed affidavit verifying the relationship between the landlord and tenant will be required.  Rental Registration Affidavit of Occupancy – Family Member

Under the approved ordinance, you, as an owner of a non-owner occupied structure or dwelling unit, are required to register your property by February 15th and submit to an inspection of the property and premises once every two years, or as needed in the investigation of complaints regarding the dwelling unit.  An occupancy license must be issued for each dwelling unit.

The owner, responsible agent or manager shall be sent a thirty (30) day notice of violation for failure to register for a Residential Rental License, warning of the failure to comply with the terms of the ordinance.  Failure to comply at the end of the thirty (30) days will result in a fine of not less than three hundred dollars ($300) per residential rental unit for each month the violation exists.  Each month the violation exists constitutes a separate violation.  

The fees for the yearly registration are as follows:

  • 1 – 12 units $80.00/per unit
  • 13 units and above $60.00/per unit
    • Base fee $275.00
  • Re-inspection $65.00/per inspection
  • Inspections Appeals Hearing $200.00/per unit
  • Inspection Cancellation Fee $50.00

The scheduling of inspections will follow receipt of the registration form and fee.

Single family dwellings where a parent, parent-in-law, or adult child of the owner remains in occupancy and no net income is earned by the owner is exempt from this ordinance.  A signed affidavit verifying the relationship between the landlord and tenant will be required. Penalties will be assessed for those who do not register their rental units, or for those providing false signed affidavits.
